Information clause on the processing of personal data in connection with the award of contracts advertised on the website of the Łukasiewicz Research Network – Poznań Institute of Technology

Pursuant to Article 13(1) and (3) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “GDPR”) we would like to inform that:

  1. The controller of your personal data is Łukasiewicz Research Network – Poznań Institute of Technology, hereinafter referred to as “Łukasiewicz-PIT”.

  4. Your personal data will be processed on the basis of Article 6(1)(c) of the GDPR, the Civil Code Act of 23 April 1964 and other legislation, including legislation concerning the archiving of documents. Your personal data will be processed for the purpose of carrying out the public procurement procedure to which the file is related.
  5. Your personal data will be stored (processed) for a period of 5 years from the end date of the procurement procedure. This period may be extended if justified by law or other obligations of the Administrator.
  6. Recipients of personal data As procurement procedures are in principle open to the public, your personal data may be provided to entities and persons who have requested to view the documentation of the procurement procedure. The recipients of your personal data provided in the documentation related to the public procurement procedure may be entities with which Łukasiewicz-PIT has entered into contracts or agreements for the use of IT systems provided by such entities for the transmission or archiving of data. The recipients of your personal data may also be persons or entities to whom the documentation of the procedure will be made available on the basis of the relevant legislation. Łukasiewicz-PIT uses Microsoft Office 365, which may result in the transfer of your personal data to a third country. The terms and conditions for the use of the MS Office 365 Online Services and the obligations with regard to the processing and safeguarding of user data and personal data by the Online Services are set out in Microsoft documentation.
  7. You have the following rights related to your personal data collected in connection with the the public procurement procedure:
    1. the right to access their data and receive its copy;
    2. the right to rectify (correct) your data;
    3. the right to erasure of personal data where the processing is not carried out for the performance of an obligation imposed by law or in the exercise of public authority;
    4. the right to restrict the processing of data, wherein separate provisions may exclude the exercise of this right;
    5. the right to lodge a complaint with the President of the Office for the Protection of Personal Data.
  8. Your obligation to provide personal data is not a statutory requirement. Nevertheless, your provision of personal data is a pre-requisite for your participation in the procurement procedure.
  9. as far as your personal data is concerned, no automated decisions shall be made, under Article 22 of the GDPR.
