Information clause on the processing of personal data in connection with the implementation of the “Tracker 2.0” project

Taking into account the contents of § 11(24) of the agreement of 19/04/2022 no. POPC.02.01.00.00-0137/22-00 in a subsidy to the “TRACKER 2.0” project as part of the Digital Poland Operational Programme for 2014-2020, Łukasiewicz Research Network – Poznań Institute of Technology hereby meets its information obligation towards each natural person, the personal data of who shall be or can be provided to the Entrusting Party or the Intermediate Body in any form, during execution of the aforementioned agreement and after its conclusion.

Depending on the type of personal data processed by the Beneficiary in connection with the execution of the Agreement, the following may be considered as natural persons towards whom the information obligation should be fulfilled:

  • employees, volunteers, apprentices and trainees representing or performing tasks for entities involved in the operation and implementation of the POPC;
  • designated contact persons, persons authorised to take binding decisions and other persons performing tasks for the Beneficiaries and its partners;
  • participants of training, competitions, conferences, monitoring committees, working groups, steering groups and information or promotion meetings organised within the framework of POPC;
  • persons, whose data will be processed in connection with the examination of the eligibility of funds in the project, including in particular: project staff, participants of tender commissions, bidders and public procurement contractors, persons providing services on the basis of civil law contracts.

 

  1. The administrator of the personal data provided within the framework of the implementation of the aforementioned project is the minister responsible for regional development, acting as the Managing Authority for the Digital Poland Operational Programme for 2014-2020, with his or her office at ul. Wspólna 2/4, 00-926 Warsaw.
  2. The processing of the provided personal data conforms to law and meets the conditions referred to in Article 6(1)(c) and Article 9(2)(g) of Regulation (EU) 2016/679 of the European Parliament and of the Council – the personal data are necessary for the implementation of the Digital Poland Operational Programme 2014-2020 (POPC) on the basis of:
    1. reference to the “Digital Poland Operational Programme” collection:
      1. Regulation (EU) No. 1303/2013 of the European Parliament and of the Council of 17 December 2013 laying down common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for Rural Development and the European Maritime and Fisheries Fund and laying down general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Fisheries Fund and repealing Council Regulation (EC) No. 1083/2006 (Official Journal EU L 347 of 20/12/2013, p. 320, as amended);
      2. Commission Implementing Regulation (EU) No. 1011/2014 of 22 September 2014 laying down detailed rules for the implementation of Regulation (EU) No 1303/2013 of the European Parliament and of the Council as regards the models for submission of certain information to the Commission and the detailed rules concerning the exchanges of information between beneficiaries and managing authorities, certifying authorities, audit authorities and intermediate bodies (Official Journal EU L 286 of 30/09/2014, p. 1).
      3. the Act of 11 July 2014 on principles of implementation of programmes in the area of cohesion policy funded in the 2014–2020 financial perspective (Journal of Laws of 2017, item 1460, as amended).
    2. with regard to the collection “Central ICT system supporting the implementation of operational programmes”:
      1. Regulation (EU) No. 1303/2013 of the European Parliament and of the Council of 17 December 2013 laying down common provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund, the European Agricultural Fund for Rural Development and the European Maritime and Fisheries Fund and laying down general provisions on the European Regional Development Fund, the European Social Fund, the Cohesion Fund and the European Maritime and Fisheries Fund and repealing Council Regulation (EC) No. 1083/2006
      2. the Act of 11 July 2014 on principles of implementation of programmes in the area of cohesion policy funded in the 2014–2020 financial perspective (Journal of Laws of 2017, item 1460, as amended).
      3. Commission Implementing Regulation (EU) No. 1011/2014 of 22 September 2014 laying down detailed rules for the implementation of Regulation (EU) No 1303/2013 of the European Parliament and of the Council as regards the models for submission of certain information to the Commission and the detailed rules concerning the exchanges of information between beneficiaries and managing authorities, certifying authorities, audit authorities and intermediate bodies (Official Journal L 286 of 30/09/2014, p. 1).
  1. My personal data will be processed solely for the purpose of implementing the TRACKER 2.0 project, in particular to confirm the eligibility of expenditure, provide support, monitoring, evaluation, control, audit and reporting, as well as information and promotional activities within the POPC.
  2. My personal data was entrusted for processing to the Intermediate Body, i.e. Centrum Projektów Polska Cyfrowa ul. Spokojna 13a, 01-044 Warsaw, to the project beneficiary Ministry of Development and Technology, pl. Trzech Krzyży 3/5 00-507 Warsaw and to entities participating in the implementation on behalf of the beneficiary: Łukasiewicz Research Network – Poznań Institute of Technology. The provided personal data may be transferred to entities carrying out evaluation research on behalf of the Managing Authority, Intermediate Body or the beneficiary. The provided personal data may also be entrusted to specialist companies carrying out inspections and audits within the POPC on behalf of the Managing Authority, Intermediate Body and the beneficiary.
  3. The provision of data is a prerequisite for receiving support and project implementation, and the refusal to provide this data is tantamount to being unable to provide support within the project.
  4. The provided personal data shall not be transferred to a third country or an international organisation;
  5. The provided personal data will not be subject to automated decision-making.
  6. The provided personal data will be stored until the settlement of the Digital Poland Operational Programme 2014-2020 and the archiving of the documentation is completed.

  8. I have the right to lodge a complaint with the supervisory body, i.e. the President of the Personal Data Protection Office.
  9. I have the right to access and rectify, erase or restrict the processing of my data.
